This Data Protection and Privacy Charter outlines the conditions under which the personal information you have provided is collected and processed by WebCheck SAS, in the context of using the EveryCheck service, allowing a User and/or a Client and/or an Employee of WebCheck to access the Services offered by EveryCheck.

I. INTRODUCTION

1. Definitions

Each term beginning with a capital letter hereafter has the meaning given to it in its definition as set out in the Terms of Use of EveryCheck.

2. General Presentation

As part of the use of EveryCheck, Webcheck Company collects personal data concerning Users and Clients. All operations on personal data are carried out in compliance with the regulations in force, in particular Law No. 78-17 “Data Processing, Files, and Liberties” of January 6, 1978, as amended, and its implementing decrees. The Charter sets out the conditions under which Users’ personal data is processed by WebCheck and, where applicable, its subcontractors. The Charter is directly accessible from the Site during registration and subsequently via a visible link in the footer on all pages of the Site. Users acknowledge having read the Charter at the same time as the Terms of Use, of which it forms an integral part. Any modification of the Charter comes into effect from its online publication date, with Users being deemed to have read the modified Charter by simply accessing the Site.

II. COLLECTION OF PERSONAL DATA

The Personal Data collected directly from the User are those provided on the forms available on the Site or upon specific request by WebCheck. The mandatory or optional nature of the responses is indicated on the form. The User and the Client are informed of their rights (right of access and communication of data, right of modification and deletion, right to object to the processing of their data), in accordance with the “Data Processing and Liberties” law. The User and the Client guarantee that the information they provide is accurate, complete, and up to date.

III. PURPOSES OF DATA PROCESSING

Personal Data is collected and used to respond to one or more purposes, including testing new services and particularly gauging clients’ interest in new proximity services available from the EveryCheck Site.

IV. RECIPIENTS OF PERSONAL DATA

The recipients of Personal Data within the meaning of Article 3 of the “Data Processing and Liberties” law are “any person authorized to receive communication of this data other than the data subject, the data controller, the processor, and the persons who, due to their functions, are responsible for processing the data.” The Personal Data you provide may be transmitted to the following recipients: WebCheck services; Public bodies, legal auxiliaries, and judicial officers, in order to comply with any applicable law or regulation, or to respond to any judicial or administrative request.

V. RETENTION OF PERSONAL DATA

The Personal Data of Clients and Candidates is retained as long as the Client has an EVERYCHECK account and for five years following the deletion of the account, regardless of the reason for its deletion.

VI. SECURITY AND CONFIDENTIALITY OF PERSONAL DATA

WebCheck Company undertakes to take all measures to ensure the security and confidentiality of Personal Data, and in particular to prevent it from being damaged, deleted, or accessed by unauthorized third parties.

VII. RIGHTS OF INDIVIDUALS WHOSE DATA IS COLLECTED AND PROCESSED

It is expressly agreed that the Personal Data collected by EveryCheck is used in accordance with the purposes described in this document. In accordance with Articles 39 and following of Law No. 78-17 of January 6, 1978, as amended, any User or Client has the right to access their Personal Data, and the right to rectify or delete incomplete or inaccurate Personal Data. These rights can be exercised via the Contact form available on the Site or by sending a letter to the following address: SAS WebCheck, 22 rue de l’Alma, 35000 RENNES Any Client can also modify their Personal Data themselves from their account on the Site. Finally, the User has the right to object to the processing of their Personal Data, provided they can justify a legitimate interest.
